Employer Nominated Scheme (ENS) Visa

Subclass 186

The Employer Nominated Scheme (ENS) Visa (Subclass 186) offers Australian permanent residency to skilled workers who wish to live and work in Australia permanently. The visa requires an Australian employer sponsorship while offering permanent residency benefits that include Medicare and citizenship eligibility.

What is Subclass 186?

The Australian government issues the Subclass 186 visa as a permanent visa to sponsor foreign workers whose Australian employers have nominated them. The visa lets you permanently live and work and study in any location across Australia. The visa has three distinct streams that applicants can use to apply.

The Application Process: Step-by-Step

Your employer lodges a nomination to sponsor you for a permanent role. They must meet eligibility, pay the SAF levy, and prove genuine need.

The Application Process: Step-by-Step

Once nominated, you submit your visa application, meet all requirements, and provide documents. Includes health, character, and skills checks.

  • Nomination
  • Visa Application

Stage 1 – Nomination

Before applying for the visa, employers need to submit their nomination request to the Department of Home Affairs. This involves demonstrating:

  • Genuine position: Employers need to establish authentic reasons to hire skilled workers for full-time positions that will remain available for at least two years.
  • The employer needs to show consistent adherence to Australian immigration and workplace laws.
  • The applicant must receive a salary from their employer that meets or exceeds the market rate for their occupation in Australia.
  • Employers need to pay the Skilling Australians Fund (SAF) Levy for each nomination they submit. The levy amount varies based on the business’s annual revenue:
Business size SAF levy (per nominee)
Annual revenue < AUD $10M AUD $3,000
Annual revenue ≥ AUD $10M AUD $5,000

(The revenue from these payments contributes to the training of Australian workers.)

Stage 2 – Visa application

You must submit your visa application through the Department of Home Affairs after the nomination is approved or within six months of receiving approval for any stream. During this phase, you need to fulfill all the requirements which are specific to your selected visa pathway.

TRT Stream

The most common pathway, allowing eligible temporary visa holders to transition to permanent residency after working for their sponsoring employer.

DE Stream

The skilled workers who seek to apply for this visa must either be in Australia or not meet the requirements of the TRT stream. The visa application needs both a successful skills assessment and work experience that matches the requirements.

LA Stream

The Australian Government allows skilled workers to apply for this stream through formal Labour Agreements with employers. The Labour Agreement Stream serves to meet particular labour needs that the government has identified.

For detailed requirements of each stream, continue reading below.

If you’re looking for a sign that you’ve chosen the right migration agent — this is it. Many can become migration agents, but not everyone does their work with genuine care and heart. That’s why choosing a migration agent with genuine care and compassion for their clients is so important. And Bill Mitroulas of Questra Immigration is definitely one of them. Our gratitude to Bill and the Questra Team is beyond words — they were the ones who made it possible for us to achieve the future we’ve been dreaming of here in Australia. Even though the process wasn’t easy and at times felt almost impossible, Bill and the Questra Team stood by us and helped us successfully complete our PR application. And because of the positive outcome of our PR application, we were able to get the house we’ve always dreamed of. In behalf of my partner, Jhoseph Paxton, we want to thank you, Bill and the Questra Team, for changing our lives — giving my children a future filled with hope and opportunity. I pray for Questra's continued success.✨
