  • You must have completed and graduated from a minimum 40-week course from a CRICOS registered tertiary institution in Tasmania ( The course undertaken must be a degree (bachelor or any higher degree), a diploma (standard, advanced, associate or graduate), or trade qualification (minimum Cert III level for a skilled occupation in Major Group 3 in ANZSCO) ) and,
  • You have lived in the state for at least 1 year during your period of study, and
  • You and your dependents are currently living in Tasmania and can provide evidence of your ongoing genuine commitment.

Tasmanian Graduate Nomination Pathway (190)

On the other hand, subclass 190 is a permanent visa for skilled migrants, giving you instant permanent residency to live and work in Tasmania.

After being nominated by the Tasmanian Government for this Visa, you should reside in Tasmania for 2 years before transferring to other states.

Requirements

  • Subclass 190 nomination applicants must have completed a course of at least 92 weeks in a full-time capacity, and have lived in Tasmania for 2 years.
  • All applicants (subclass 190 and 491) must provide a career plan explaining how their studies have increased their ability to find skilled work in Tasmania (unless already working in a skilled capacity).
  • Certificate III / IV studies must be directly related to a Priority Industry Training and Workforce Development Area. (Find the list below)
  • All applicants who do not hold a Student visa at the time they complete their studies must have completed a course directly related to a Priority Industry Training and Workforce Development Area.
  • All applicants must have reasonable prospects for skilled employment within 2-3 years of nomination.

How to Apply

 

  • Check your Eligibility
    In order to start your application, you should check first if you meet all the requirements set by the Department of Home Affairs for skilled migration.
  • Check your Requirements
    Verify if there are additional requirements from the Tasmanian Government that you need to submit.
  • Lodge your Expression of Interest (EOI)
    If all requirements have been secured, lodge your EOI in Skillselect.
  • Apply for your Nomination
    Send your application to the Tasmanian Government using their official website. Wait for 2-3 months of processing to get your possible state nomination. However, state nomination is not a guaranteed Visa approved, you still need to be approved by the Department of Home Affairs.
  • Apply for your Visa
    Suppose you received a nomination from the Tasmanian Government. In that case, you will indeed have an invitation to apply for your Visa using skillselect. Apply for your Visa and wait for the processing result of the Department of Home Affairs.
  • Maintain your Obligations

Australian Government endorsed events (COVID-19 Pandemic event)

In response to the COVID-19 pandemic and with an aim to sure up critical sectors relying on temporary workers, the Australian government has introduced a Subclass 408, COVID-19 visa. Under the guidance, temporary visa holders will be able to remain in Australia.

Temporary visa holders with work rights will be able to access the COVID-19 Pandemic Event (Subclass 408) visa incurring no Visa Application Charge for a period of 6 or 12 months if they work in any sector of the Australian economy.

Removing sector limitation for eligibility for the COVID-19 Pandemic Event visa will provide further support to Australian businesses and a means to retain temporary migrants who are working, or are able to work in a range of sectors across the economy. These settings are subject to ongoing review.

Which are the Critical Sectors?

The Australian government has listed 7 industries that are critical to the COVID-19 response:

  1. agriculture
  2. food processing
  3. health care
  4. aged care
  5. disability care
  6. childcare
  7. hospitality and tourism (added 10 May 2021).

 

What would be the visa duration if I am not working in a critical sector?

6 months if working or intending to work in  any other sector. 

 

Who is eligible for the Subclass 408, COVID-19 visa?

Any temporary visa holder (Student visa, Working Holiday visa, Graduate visa) who intend to work in or are working in either one of the above listed Critical Sectors.

 

Is it really true that Hospitality and tourism has been added to the critical sectors?

The Hon Alex Hawke MP Minister for Immigration, Citizenship, Migrant Services and Multicultural Aff​airs made an official announcement on Saturday, 10th May 2021.

This effectively means that anyone working in the hospitality industry in a back of house role as a chef, cook, kitchen hand and/or dishwasher is eligible. In addition, anyone in a front of house role as a restaurant manager, bar person, barista, waiter or even a runner will be eligible for this visa.

 

When should I apply?

If you are employed or have an employment offer in one of the Critical Sectors, clearly you can make an application within 90 days of your current temporary substantive visa expiry date.

 

How long will it be valid for?

If you work in a Critical Sector and you have evidence from an employer or an offer of employment, this visa allows you to remain in Australia for up to 12 months.

 

Do I get full work rights?

The short answer is that you will get full work rights, whether if you are working in a Critical Sector or not.

 

Will there be any conditions attached to my visa?

408 visas are usually accompanied by the 8107 Work Limitation clause. As a result, this means as a holder of this visa you must only work for a specific employer that will be listed on your grant notice.

 

What happens if I need to change employers?

Even though your visa will be imposed with condition 8107, it is still possible to change employers, although, you will have to email the department a Form 1022 with the details of your new employer.

 

How much does it cost?

There is no visa application charge for this visa, not does any subsequent temporary charge apply.

 

Can I include Family members?

You can include members of your family who are in Australia with you in your application when you apply.

 

Can I still work full-time if I have a student visa or extend my student visa?

Student visa holders employed in hospitality and tourism have had restrictions on their working hours removed. The previous 40-hour fortnightly limit applied during study periods are no longer enforced for student visa holders who are working in the tourism and hospitality industry.

This is a new flexible approach to students working beyond the usual work limitations and applies to student visa holders working in the following industries:

  • Health sector: enrolled in a health-related course (such as nursing or medicine) and are directed by a health official to assist in the effort against COVID19
  • Aged-care
  • Child-care
  • Disability-care, employed by NDIS
  • Agriculture sector
  • Tourism and hospitality sector

Eligibility Requirements for International Graduates of South Australia

  • Your course should be registered in the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS).
  • The course must be a minimum of 46 weeks (1 Year) and CRICOS registered.
  • A minimum of 50% of your qualification must have been completed in South Australia.
  • You must have resided in South Australia for at least 1 year during your period of study.
  • You must have continuously resided in South Australia post-course completion.
  • You must meet the nomination requirements outlined here and as listed for your nominated occupation.
  • SA graduates must be currently working in their nominated or closely related occupation for the last 3 months in South Australia (post-course completion) unless specified differently for your occupation.
  • You must be working at least 20 hours per week or 40 hours per fortnight in your nominated or closely related occupation in South Australia for the duration required for your nominated occupation unless specified differently for your occupation. (If you are working part-time (less than 35 hours per week), you may be offered a 491 nomination.)
  • Where specified, some occupations may require longer work experience requirements.

Pass a Skill Assessment: Whether this is based on your completed course in SA or previous education and work experience, you should successfully complete your skills assessment.

Apply for State Nomination: Once you have completed all the requirements, you can now lodge an EOI through the Skillselect. From there, you can select and apply for a South Australian Government state nomination.

South Australia State Nomination Requirements

In order to fulfil SA state nomination requirements, you should be able to satisfy the following requirements as listed by the SA state government:

Residency Requirements

You need to be residing in South Australia to be able to apply for South Australia State and Regional Sponsorship.

Age 

Be under age 45 at the time of nomination.

Occupation 

Have an occupation on South Australia’s Skilled Occupation list and meet the eligibility requirements for that occupation.

Skills Assessment 

Have a valid and positive General Skilled Migration skills assessment from the relevant authority.

Work experience 

Skilled work experience must be undertaken post-course completion and is defined as a minimum of 20 hours per week or 40 hours per fortnight of paid employment in your nominated or closely related occupation.

Some concessions apply if,

We engaged with Questra through my classmate. After initially consultation with lawyer- Bill, we decided to see how it goes. Basically, you would be assisted by Questra team with your application. Lots of people might think you engage with law firm and paid them nothing is needed to be worried. I have to slightly correct those idea from people who wish engaging with Questra. First of all, it’s your responsibility to provide legitimate information to them. The team of Questra is playing a role like a coach to assist with your application to become more smoothly and persuasively way but remain all legitimate information for your application. Hence, you have to write all information that you wish to include into your application by yourself first. During our preparation phase before offical lodgement of our application, we have been assisted by all Questra team and ensured all supportive information have been provided and if we missed anything, the team will let us know ASAP. We got our 820 very soon after lodging our application within 6 months during Covid, which we were very grateful for the result and after two years of waiting, we continued with Questra to lodge our 801 as they have all information of ours. We received our 801 within 11 months of waiting time. However, this timeframe is just for your reference as each case have different requirements and conditions that might be required more time to process. In the conclusion, we are very grateful to engage with Questra, they made the whole process was so smooth and less hassle for us. We highly recommended to engage with them if your need some assistance with your visa application.
