Partner visa changes you weren’t aware of
The Australian Government announced that it will implement reforms to strengthen the integration results of the Partner Program. The partner visa changes became mandatory in November 2021.
It has been a few months since these changes began and we wanted to make sure you clearly understood the new requirements to apply for a partner visa.
Prior to November 2021, sponsorship and partner visa applications were filed at the same time and there were no English requirements for the partner or their sponsor.
NEW SPONSORSHIP FRAMEWORK FOR THE PARTNER VISA PROGRAM
The new reforms will divide partner visa applications into two steps:
- The sponsor must submit their sponsorship: Apply the sponsorship framework established in the Migration (Family Violence and Other Measures) Amendment Act 2018 to the partner visa program.
- Sponsorship must be approved before the partner visa application can be submitted.
This means that sponsorship applications will be assessed separately and must be approved before a valid partner visa application can be submitted.
This change will negatively affect partner visa applicants on land who wish to submit a visa application before their substantive visa expires. If you plan to apply for a partner visa, we recommend that you register for our free seminar to discuss and understand how these changes may affect you.
ENGLISH LANGUAGE REQUIREMENT
The new English language requirement for partner visa applicants and permanent resident sponsors will encourage and support the acquisition of English.
Under the family sponsorship framework, sponsors who are permanent residents of Australia and partner visa applicants will be required to provide evidence of a functional level of English or demonstrate that they have made reasonable efforts to learn English when they reach the partner visa stage permanent.
Reasonable efforts may include the completion of free English classes through the Adult Migration English Program (AMEP). Immigrants can now access as many hours as they need to achieve functional English.
Other ways to meet the English language requirement could be an adequate score on an approved English language test; holding a valid passport from Australia, Canada, Ireland, New Zealand, the United Kingdom and the United States or where the applicant has obtained a qualification where all instruction was in English.
