Requirements

To be eligible for the Employer Nomination Scheme (ENS) TRT stream under the ENS 186 visa, both the visa holder and their employer must meet certain criteria:  

For the Employer: 

  • Nomination: The employer must nominate the applicant for a position that is likely to be available for at least 2 years.  
  • Genuine Need: The employer must demonstrate a genuine need for the nominated position within their business.

For the Visa Holder: 

  • Work Experience: The applicant must have worked for their nominating occupations for at least 2 years on a subclass 482 Visa in the nominated occupation.  
  • English Language Proficiency: The applicant must demonstrate competent English language proficiency, typically achieved through approved English language tests.  
  • Health and Character Requirements: The applicant must meet the health and character requirements specified by the Australian government.

                The latest Skills in Demand (SID) Visa Subclass 482 is a temporary visa that allows Australian employers to sponsor skilled workers from overseas to fill positions they cannot find suitable Australian workers for. This visa, which replaced the Temporary Skill Shortage (TSS) visa on December 7, 2024, aims to address labour shortages and attract global talent to Australia. 

                The introduction of this visa is aligned with insights from the Jobs and Skills Australia (JSA), regional demands and input from key industry stakeholders across the country. The SID Visa is a powerful step in responding to the changing economic, social and labour market needs of Australia.  

                 

                General overview:  

                • Allows the applicant to stay in Australia for up to 4 years  
                • Hong Kong passport holders may stay for up to 5 years  
                • Costs start from AUD $3,115  
                • If eligible, applicant can apply for Permanent Residency  

                Eligibility criteria

                1. Eligible occupations 

                To qualify for the Skills in Demand Visa, your occupation must be listed on the Core Skills Occupation List (CSOL) or meet the income threshold for the Specialist Skills stream. The CSOL covers 456 occupations across critical sectors, with a reduction of 125 occupations from the previous TSS occupation list.  

                2. Required skills 

                Applicants must have the necessary skills and qualifications for the nominated position. This may involve completing a skills assessment to demonstrate your capabilities. 

                3. Experience requirement

                • The work requirement has been reduced from 2 years to 1 year of relevant experience. This experience must have been undertaken in the past 5 years and can be in the nominated occupation or a related field.  
                • The 1 year of relevant experience is now a Time of Application requirement; meaning you must have the relevant 1 year of experience at the time of your visa lodgment.
                • Applicants can no longer accumulate experience towards the work experience requirement whilst their visa application is processing.   

                 4. English requirement

                Applicants must meet the English language proficiency standards, which include an IELTS score of at least 5.0 overall with a minimum of 5 in individual components or equivalent scores in other accepted tests. 

                5. Salary requirement 

                The minimum salary for the Skills in Demand Visa is determined by the Core Skills Income Threshold (CSIT), currently set at AUD $73,150 per annum. The minimum annual salary (SSIT) for the Specialist Skills stream is AUD $135,000.

                The Skills in Demand Visa offers a clear pathway to permanent residency through the Employer Nomination Scheme (subclass 186). After 2 years of employment in Australia, you can apply for Permanent Residency under the Temporary Residence Transition (TRT) stream.

                You can include family members in your Skills in Demand Visa application. Family members can stay in Australia for the duration of their visa and enjoy the same rights to work and study. 

                 

                Which family members can be included in your SID Visa application?  

                • Only a Member of the Family Unit is eligible to be included in your application.  
                • This includes a spouse or de factor partner, and certain dependent children.  
                • Please note that this does not include your parents or your siblings. 

                Steps in applying for the SID Visa

                1. Sponsorship from your employer  

                Your employer must:  

                • Be or become an approved sponsor to sponsor overseas workers  
                • Comply with Australian workplace laws  
                • Meet the training requirement 

                2. Nomination from your employer 

                Your employer must:  

                • Conduct Labour Market Testing (LMT) before submitting your nomination  
                • Meet the salary and employment requirements  
                • Meet the genuine position requirements  

                3. Visa application from you

                This is the final step in the process. You must have a valid nomination approval before you can lodge your visa application. Ensure you meet all the eligibility criteria and provide the necessary documentation.

                Can I switch employers while on the Skills in Demand Visa?

                Yes, Skills in Demand Subclass 482 Visa holders can change sponsors and have 180 days to secure a new sponsor without breaching visa conditions. 

                What happens if my family circumstances change after lodging my visa application?

                You can add family members to your visa application even after it has been lodged, provided you notify the Department of Home Affairs and submit the required documentation. 

                How long can I stay in Australia on the Skills in Demand Visa?

                We engaged with Questra through my classmate. After initially consultation with lawyer- Bill, we decided to see how it goes.                 Changes to the 186 Permanent Residency Visa – December 2024 Update

                In 2024, the Australian Government introduced several positive migration policy changes to address labour market needs and provide skilled migrants with accessible pathways to Permanent Residency.  

                As of 7th December 2024, significant changes have been made to the Employer Nomination Scheme (subclass 186) visa. These changes affect the Temporary Residence Transition (TRT) and Direct Entry (DE) streams, aligning with the recent Migration Strategy to simplify Permanent Residency pathways. These long-awaited changes have come into effect as the Government focuses on its redefined Migration Policy to create a clear pathway to permanent residency. 

                Here is a summary of the key changes: 

                Changes to the Temporary Residence Transition (TRT) Stream

                1. Expanded work experience criteria  

                TRT stream applicants can now count all periods of sponsored employment towards the 2-year work experience requirement if employed in occupations listed on their current Subclass 482 Grant letter. This includes employment with previous sponsors under the TSS or SID Program.

                2. Applicants must provide evidence of work experience 

                The responsibility to demonstrate the required employment period for Subclass 186 TRT has shifted from the employer to the applicant. Applicants must now provide their own evidence to show they meet the work experience requirement, rather than relying on the nominating employer. This change provides applicants with greater flexibility.

                3. Introduction of the Core Skills Income Threshold (CSIT) 

                The Temporary Skilled Migration Income Threshold (TSMIT) has been replaced by the Core Skills Income Threshold (CSIT). The threshold is set at AUD $73,150, indexed annually. This applies to both the TRT and DE streams.  

                 All applicants are required to provide an Income Statements as evidence of employment in their occupation for the required period, which is currently 2 years. Please note that any unpaid holiday or unemployment period cannot be included towards this requirement. 

                 4. Age Exemptions 

                Unfortunately, age exemptions remain unchanged. The cut-off age remains at 45 years at the time of the application. There are age exemption provisions for regional medical practitioners and high-income applicants.

                5. Exclusion of Regional Sponsored Migration Scheme (Subclass 187) 

                The changes to the TRT stream do not extend to the Regional Sponsored Migration Scheme (subclass 187), which has been closed since 2019. In limited circumstances, eligible transitional groups still retain their existing access.  

                Please note that if your occupation has been removed from the CSOL list and you currently hold a Subclass 482 Visa, you may still be eligible to apply for the 186 Visa. 

                Changes to the Direct Entry (DE) stream 

                For applicants directly pursuing permanent residency, the updates provide more targeted alignment with Australia’s labour needs: 

                1. Introduction of the Core Skills Occupations List (CSOL)  

                The introduction of the new Core Skills Occupation List (CSOL) replaces the Medium and Long-Term Strategic Skills List. The comprehensive list is based on the labour market analysis and stakeholder consultation by Jobs and Skills Australia (JSA). The list targets priority sectors like: 

                • Construction 
                • Cybersecurity 
                • Agriculture 
                • Health and Education 
                • Hospitality and Tourism 

                2. Application of CSIT (Replacement of TSMIT) 

                Similar to the TRT stream, the CSIT also applies to the Direct Entry stream, with an income threshold of AUD $73,150, indexed annually.  

                3. Skills Assessment 

                Applicants still need a skills assessment under the Direct Entry stream of the 186 Visa. It is important to note that most of the skills assessing authorities are currently experiencing a backlog of several months, so please allow plenty of time for this step of your visa application.  

                Applicants are required to undergo a Skill Assessment under the appropriate code specified in the CSOL List and conducted by the designated authority. It should be noted that certain ANZSCO codes and their corresponding responsible authorities have been updated. 

                What do these changes mean for Skilled Migrants? 

                These updates simplify the requirements for skilled migrants and streamline the process by offering: 

                • Greater flexibility in meeting work experience requirements, especially for those with extensive employment histories or career advancements. 
                • Simplified eligibility criteria through the adoption of the CSOL and CSIT, supporting priority industries. 
                • Continued support for high-demand professions, including regional medical practitioners and critical sectors like construction and healthcare.

                Looking ahead

                • These changes mark a significant shift in Australia’s migration policies, emphasizing skilled migration aligned with national priorities. They streamline pathways for Employer Sponsored Visa holders and address critical labour shortages in various sectors. 
                • The Government has not yet released its complete policy on these changes, leaving many unknowns, particularly for visa holders with multiple sponsors. We will keep our clients updated via this platform and our weekly newsletter.
