Migration update: ANZSCO changes to OSCA

Migration update: ANZSCO changes to OSCA

Migration update: ANZSCO changes to OSCA

ANZSCO is changing to Occupation and Skills Classification of for Australia (OSCA). Read on to find out what this change means.

The Australian Bureau of Statistics (ABS) has recently announced a significant transition from the Australian and New Zealand Standard Classification of Occupations (ANZSCO) to the new Occupation and Skills Classification for Australia (OSCA). This change is set to revolutionise the way skilled occupations are classified and is crucial for migrants, employers, and stakeholders to understand its implications.

What Is the OSCA and Why the Change?

The OSCA is designed to reflect the current Australian labor market better, capturing more detailed information about the skills and qualifications required for various occupations. Unlike its predecessor, the ANZSCO, which was last updated comprehensively in 2006, OSCA is set to be a more dynamic and responsive classification system. The transition aims to ensure that the classification system remains relevant and accurately represents the evolving job landscape.

Impact on Immigration Policy

It is important to note that the Minister for Immigration will need to issue a new Legislative Instruments Instrument to bring the OSCA changes into effect. The Department of Home Affairs will officially announce this process to bring the OSCA changes into effect. The Department of Home Affairs will officially announce this process in due time, with the specific date of change to be provided. Although the OSCA changes are scheduled for December 6th, this does not immediately alter immigration legislation and policy. The existing policies will remain in place until the new legislative instrument is enacted. The Department of Home Affairs will officially announce this process.

For skilled migrants, the shift from ANZSCO to OSCA is particularly significant. Visa applications will need to align with the new OSCA classifications, which may affect eligibility criteria, occupation lists, and points assessments. Migrants should review the new classifications and ensure their qualifications and work experience match the updated requirements. Employers sponsoring skilled migrants will also need to familiarize themselves with OSCA to ensure compliance and facilitate smooth visa processing.

Key Changes for Migrants

Update Occupation Lists: The new OSCA classification will reflect current labor market demands more accurately. This means that some occupations may be added or removed from the skilled occupation lists used for visa applications. Migrants ill need to check the updated lists to ensure their occupation is still eligible for migration.

Potential Changes in Visa Eligibility:The new OSCA classifications may affect visa eligibility for certain occupations. Migrants should review the updated requirements to ensure they meet the eligibility criteria for their desired visa subclass.

Skills Assessment: Skills assessment authorities will update their criteria to reflect OSCA classifications. This may impact the assessment outcomes for prospective migrants, particularly those in occupations that have undergone significant changes. Migrants should ensure their skills assessments are aligned with the new OSCA requirements.

Employer Sponsorship: Employers sponsoring skilled migrants will need to familiarize themselves with the new OSCA classifications to ensure compliance with visa requirements. This includes updating job descriptions and ensuring that sponsored positions align with the new classification.

Need more information? Read our Frequently Asked Questions (FAQs) below or book a consultation with one of our expert agents to understand how these changes may apply to you.

When will the transition to OSCA take place?

The transition is scheduled to occur soon, with specific dates to be announced by the ABS. Migrants and employers should stay informed through official Home Affairs communications.

Will all occupations be affected by this change?

Yes, all occupations currently listed under ANZSCO will be re-evaluated and reclassified under OSCA, ensuring they align with modern labour market demands.

Will OSCA reference the relevant ANZSCO classifications during the transition period?

Yes, OSCA will reference the relevant ANZSCO classifications during the transition period. Correspondence files between ANZSCO and OSCA will be available to help users understand the changes and align their data with the new classification system.

How long will the transition period last?

The exact duration of the transition period has not been specified, but it is expected to last long enough to accommodate the needs of various users, including those involved in immigration processes, skills assessments, and other applications that rely on occupational classifications.

We engaged with Questra through my classmate. After initially consultation with lawyer- Bill, we decided to see how it goes. Basically, you would be assisted by Questra team with your application. Lots of people might think you engage with law firm and paid them nothing is needed to be worried. I have to slightly correct those idea from people who wish engaging with Questra. First of all, it’s your responsibility to provide legitimate information to them. The team of Questra is playing a role like a coach to assist with your application to become more smoothly and persuasively way but remain all legitimate information for your application. Hence, you have to write all information that you wish to include into your application by yourself first. During our preparation phase before offical lodgement of our application, we have been assisted by all Questra team and ensured all supportive information have been provided and if we missed anything, the team will let us know ASAP. We got our 820 very soon after lodging our application within 6 months during Covid, which we were very grateful for the result and after two years of waiting, we continued with Questra to lodge our 801 as they have all information of ours. We received our 801 within 11 months of waiting time. However, this timeframe is just for your reference as each case have different requirements and conditions that might be required more time to process. In the conclusion, we are very grateful to engage with Questra, they made the whole process was so smooth and less hassle for us. We highly recommended to engage with them if your need some assistance with your visa application.

Australia Introduces Core Skills Occupation List to Modernize Skilled Migration

Australia Introduces Core Skills Occupation List to Modernize Skilled Migration

Australia Introduces Core Skills Occupation List to Modernize Skilled Migration

In a significant move to streamline the temporary skilled visa program, the Australian Government has announced the release of the Core Skills Occupation List (CSOL). This new list is set to replace the outdated and complex occupation lists previously used, marking a major step forward in the country’s immigration policy.

A Modern Approach to Skilled Migration

The CSOL is a single, consolidated list that has been meticulously crafted through labour market analysis and extensive stakeholder consultations conducted by Jobs and Skills Australia (JSA). It includes 456 occupations, providing a more flexible and up-to-date framework for temporary skilled migration.

Implementation and Impact

The CSOL will be implemented in the Core Skills stream of the new Skills in Demand visa, which is scheduled to replace the Temporary Skill Shortage (subclass 482) visa on 7 December 2024. Additionally, the CSOL will apply to the Direct Entry stream of the permanent Employer Nomination Scheme (subclass 186) visa. This change aims to simplify the visa application process and better align it with current labour market needs. nt) 5.5.

Looking Ahead

Further details on other upcoming reforms, including the Skills in Demand visa and the National Innovation visa, are expected to be announced shortly. These reforms are part of the government’s broader strategy to enhance Australia’s skilled migration system, ensuring it meets the evolving demands of the economy.

Stay tuned for more updates as the Australian Government continues to refine and improve its immigration policies to support both employers and skilled workers.

New changes in the student visa – 2024

New changes in the student visa – 2024

New changes in the student visa – 2024

In March 2024, the Australian government announced changes to the student visa requirements. These updates aim to ensure students coming to Australia are serious about their studies and have the correct language skills.

Let’s see what’s changing:

1. Genuine Student Requirement:

The Genuine Temporary Entrant (GTE) requirement is getting a makeover. It will now be known as the Genuine Student (GS) requirement. This means applicants will need to provide evidence to show they’re serious about their studies, helping the Department of Home Affairs sift out genuine students from the rest.

2. English Language Requirements:

Early in 2024, the Australian Government is ramping up the English language requirements for student visas. This is to better support students in their learning journey and future employment prospects.

Here’s what’s changing:

  • For a Student 500 visa, the required IELTS (or equivalent) score is increasing from 5.5 to 6.0.
  • For students taking an English Language Intensive Course for Overseas Students (ELICOS) before their main studies, the required score goes up from 4.5 to 5.0.
  • Students enrolling in university foundation or pathway programs with reputable English language training will need a score of IELTS (or equivalent) 5.5.

3. Delayed Concurrent Enrollment:

Another significant change is that providers won’t be allowed to concurrently enroll students who haven’t completed 6 months of their principal course.

This means students need to demonstrate their dedication to their studies before receiving official enrollment confirmation for additional courses.

4. Increased Financial Proof:

Additionally, international students will need to prove they have more savings when applying for a student visa. This ensures they can support themselves financially during their stay in Australia.

These updates are designed to maintain the integrity of Australia’s education system and provide a supportive environment for students to thrive. So, if you’re planning to study in Australia, make sure you’re prepared for these changes. Good luck with your studies abroad!

2023’s most important immigration changes in Australia

2023’s most important immigration changes in Australia

2023’s most important immigration changes in Australia

The Australian Government has made a new plan to fix some problems with their immigration system. Here are some important things to know:

Migration Plan:

  • They will plan immigration for more than just one year.
  • Fewer people will be allowed to move to Australia in the coming year, and this will continue for some time.
  • They are replacing a visa called Temporary Skilled Shortage with a new one called Skills in Demand. This new visa has different rules depending on how much money you earn and what kind of job you have.

Skills in Demand Visa:

  • The Skills in Demand visa will be replacing the Temporary Skilled Shortage (subclass 482).
  • The Skills in Demand Visa lets people stay in Australia for 4 years.
  • People with this visa can change their job sponsor within 180 days.
  • If you have this visa, you can apply for permanent residency.
  • They are making it easier for employers to hire people from overseas.

Skilling Australians Fund (SAF) Levy:

  • Discussions about a new payment model for the SAF Levy allowing smaller increments over time.

Labour Market Testing (LMT):

  • The requirement to advertise on Workforce Australia has been scrapped.
  • The LMT advertising period will increase from 4 to 6 months.
  • Government indicates a gradual phasing out of the LMT requirement

Points Test – General Skilled Migration:

  • A new points test will be developed to streamline skilled migration.

    Student Visas:

    • Replacing the ‘Genuine Temporary Entrant’ requirement with the ‘Genuine Student Test.’
    • Efforts to control the number of student visa applications being processed.
    • Increased English language test score requirements.
    • Reduction in the list of eligible courses and restrictions on course swapping.

      Temporary Graduate Visas:

      • Prohibition on applying for another student visa.
      • Reduced eligibility age from 50 to 35 years.
      • Increased English language test score requirements.
      • Extended eligibility for students in regional areas.

        Regional Migration:

        • Increased support for regional areas with fast-tracking of regional visa applications.
        • Collaboration with regional areas to identify population needs and skill shortages.

          Working Holiday Makers:

          • No dramatic changes announced yet, but potential changes to length of stay and the 88-day work requirement are being discussed.

Global Talent and Business Innovation and Investment:

            • Focus on applicants who can make a substantial contribution to Australia.
            • Consideration of a new ‘Talent and Innovation’ visa.
            • Expected continuation of the Significant Investor stream for the Business Innovation and Investment visa.

These changes are part of the Australian Government’s effort to reform its migration system, and the strategy is expected to be introduced in late 2024, subject to legislation being introduced. Further details are yet to be released, and updates will be provided as the changes roll out.

New changes to the employer sponsor visas

For those dreaming of making Australia their permanent home, there’s great news on the horizon.

The Australian government is introducing significant changes to its migration system, aiming to make the journey from temporary to permanent residence smoother and more accessible for skilled workers.

In this article, we’ll walk you through the key changes that will take effect from November 25, 2023.

              Why the changes?

The current pathways to Permanent Residence (PR) for temporary skilled visa holders often result in a growing number of ‘permanently temporary’ residents.

Recognizing this challenge, the government is dedicated to creating clearer pathways to PR for all Temporary Skill Shortage (TSS) visa streams. The goal is not only to attract the skilled workers Australia needs but also to simplify the nomination process, providing certainty to both employers and TSS visa holders.

What’s Changing with the TSS Visa?

Starting November 25, 2023, exciting changes are coming to the Short-term Stream of the TSS visa:

              • Lodging Applications in Australia:

Limits on the number of Short-term Stream TSS applications will be removed, allowing applicants to lodge multiple applications from within Australia.

              • Travel Requirements for Expired Visas:

Short-term Stream TSS holders with visas expiring before the changes will need to travel outside Australia to lodge a third short-term Stream TSS application.

              Enhancements to the TRT Stream:

For the Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS) and Regional Sponsored Migration Scheme (RSMS) visa subclasses, several positive changes are coming:

              Eligible Visa Requirements:

                    • Employers can nominate holders of all TSS visa streams, including Short-term and Labour Agreement streams.
                    • Nominees must have held their TSS (or subclass 457) visa(s) for 2 out of the last 3 years before nomination.

              Nominated Occupation Updates:

                    • Nominated occupations will no longer be restricted by skilled migration occupation lists.
                    • The nominated occupation must be listed in the Australian and New Zealand Standard Classification of Occupations (ANZSCO), with the nominee continuing to work in the nominated occupation for their TSS visa(s).

              Work Experience Adjustments:

The required period for TSS visa holders to have worked in a position with their sponsoring employer will be reduced to 2 out of the last 3 years before nomination.

              Changes to Age Exemptions:

                    • Age exemptions for regional medical practitioner applicants and high-income earning applicants aged 45 years and over will be adjusted to allow for a two-year pathway.
                    • COVID-19 related age exemptions will be terminated as a result of the two-year pathway.

These changes mark a significant step towards providing more equitable access to PR for all TSS visa holders.

As we eagerly anticipate these improvements, Questra Immigration is committed to keeping you informed and assisting you in navigating these exciting updates.
