Skills and qualifications:

To meet occupation requirements for a TSS visa (subclass 482), you must have at least a relevant Australian Qualifications Framework (AQF) Certificate III or equivalent, or higher qualification, or have 12 months of relevant full time work experience, or equivalent part time experience.

Work experience:

There are no minimum levels of post qualification work experience that needs to be met to satisfy visa criteria for a Temporary Skill Shortage visa (subclass 482).

Salary Requirements:

To be eligible for the agreement, care workers must earn a minimum annual salary of at least $51,222 or the Australian Market Salary Rate, whichever is higher.

Age:

There is no age limit for the Temporary Skill Shortage visa (subclass 482). The age limit for an Employer Nomination Scheme visa (subclass 186) is 45 years of age

Labour market testing:

The establishment, and maintenance, of an MoU with the relevant industry union(s) will satisfy the labour market testing requirements

Streamlined Visa Processing:

The agreement offers simplified visa nomination and priority visa application processing, reducing the obstacles for aspiring aged care workers.

We engaged with Questra through my classmate. After initially consultation with lawyer- Bill, we decided to see how it goes. Basically, you would be assisted by Questra team with your application. Lots of people might think you engage with law firm and paid them nothing is needed to be worried. I have to slightly correct those idea from people who wish engaging with Questra. First of all, it’s your responsibility to provide legitimate information to them. The team of Questra is playing a role like a coach to assist with your application to become more smoothly and persuasively way but remain all legitimate information for your application. Hence, you have to write all information that you wish to include into your application by yourself first. During our preparation phase before offical lodgement of our application, we have been assisted by all Questra team and ensured all supportive information have been provided and if we missed anything, the team will let us know ASAP. We got our 820 very soon after lodging our application within 6 months during Covid, which we were very grateful for the result and after two years of waiting, we continued with Questra to lodge our 801 as they have all information of ours. We received our 801 within 11 months of waiting time. However, this timeframe is just for your reference as each case have different requirements and conditions that might be required more time to process. Sponsorship may be the best way for many people already in Australia to stay because it provides a clear, well-structured path to get your Temporary Skill Shortage (subclass 482) sponsorship visa, which can lead to citizenship. 

 There are three categories of the TSS visa.  

  1. The short-term stream. 
  2. The medium-term stream. 
  3. Labour Agreement stream visa.

    The short-term stream and medium-term stream TSS visas help Australian businesses sponsor skilled overseas as per actual skill shortages recorded in the combined skilled occupation list.  

    Some Australian businesses also enter into Labour Agreements with the Australian government. In light of actual or potential skill shortages in the Australian workforce, they can sponsor overseas workers to work for them in Australia.  

    Sponsored employees of such registered employers are required to immigrate to Australia on a TSS visa under the Labour Agreement stream. TSS visa holders can study while working if they hold a medium-term or labour agreement stream visa.  

    Upon obtaining a Subsequent Entrant visa, you can also bring your family with you. 

    Although sponsorship will remain a challenge, depending on your experience, it is still possible and makes a lot of sense for Australian businesses.   

      When looking for a sponsorship, here are some things you can do:

      1. Look for employment opportunities in the market: You can add the keyword “Sponsor” to the role you are trying to get hired. You should be aware that not all companies in Australia can offer sponsorship. Before employers can begin hiring employees under sponsorship arrangements, they must also undergo an Australian government screening process. 
      2. Create an astonishing cover letter: Human resources managers often have at least 100 applications piled high on their desks, and you have to make an impression in order to get their attention for an interview and writing a good Cover letter can distinguishes you from other candidates. 
      3. Resume (CV): It is important that you find an international template for your resume, sometimes people add so much detail into their resumes but at the end they are not giving the employers valuable information about how their work experience can fit into vacant position.

      It’s a good tip to include the keywords of the job description and relate them to your work experience so that when the employer reads them, they will find them relevant to the position they are seeking.  

      It is also important because most companies use software that scans resumes to see if they contain the keywords in the job description, and if you fail the filter, any human will read it.

      What should I do if my Visa application was refused?

      The Administrative Appeals Tribunal (Tribunal) can review decisions made by the Department of Immigration and Home Affairs to refuse or cancel visas. The Tribunal can also review decisions relating to approval and cancellation of sponsorship and nomination applications.

      Are there time limits for seeking merits review?

      Strict time limits apply to applications relating to decisions about visas made by the Department of Home Affairs. The time limit for making an application to the Tribunal is usually 21 days after you receive the decision you want to review.

      What happen after the Tribunal decision?

      When the AAT reviews a decision, they have the power to affirm, set aside or remit the decision.

      Affirm: If the tribunal affirms the decision under review and decided that the decision under review should not be changed. The effect of this is that the decision remains in force. Speak to us at this stage to determine your prospects of judicial review.

      Set aside: If the tribunal set aside the decision under review, and require that the decision should be changed. The Tribunal may replace (substitute) the decision with a new decision.

      Remit: If the tribunal remits the decision under review, it has decided that the decision should be reconsidered. The effect of this is that the department is required to reconsider the application having regard to any directions made by the Tribunal.

      We engaged with Questra through my classmate. After initially consultation with lawyer- Bill, we decided to see how it goes. Basically, you would be assisted by Questra team with your application. Lots of people might think you engage with law firm and paid them nothing is needed to be worried. I have to slightly correct those idea from people who wish engaging with Questra. First of all, it’s your responsibility to provide legitimate information to them. The team of Questra is playing a role like a coach to assist with your application to become more smoothly and persuasively way but remain all legitimate information for your application. Hence, you have to write all information that you wish to include into your application by yourself first. During our preparation phase before offical lodgement of our application, we have been assisted by all Questra team and ensured all supportive information have been provided and if we missed anything, the team will let us know ASAP. We got our 820 very soon after lodging our application within 6 months during Covid, which we were very grateful for the result and after two years of waiting, we continued with Questra to lodge our 801 as they have all information of ours. We received our 801 within 11 months of waiting time. However, this timeframe is just for your reference as each case have different requirements and conditions that might be required more time to process. In the conclusion, we are very grateful to engage with Questra, they made the whole process was so smooth and less hassle for us. We highly recommended to engage with them if your need some assistance with your visa application.
