Transitioning from 482 Visa to Permanent Residency via Employer Nomination Scheme 186 TRT Visa

If you are a current subclass 482 under Skills in Demand (SID) Visa or Temporary Skill Shortage (TSS), the journey towards permanent residency (PR) in Australia can be both exciting and complex.

One of the most practical pathways is through the Employer Nomination Scheme (ENS) Temporary Residence Transition (TRT) stream, specifically the ENS 186 visa.

This article will provide detailed insights into the requirements, important information for the employer, key information for the visa applicant, and the necessary steps to transition from a Subclass 482 to permanent residency successfully.

Requirements

To be eligible for the Employer Nomination Scheme (ENS) TRT stream under the ENS 186 visa, both the visa holder and their employer must meet certain criteria:

For the Employer:

  • Nomination: The employer must nominate the applicant for a position that is likely to be available for at least 2 years.
  • Genuine Need: The employer must demonstrate a genuine need for the nominated position within their business.
  • Market Salary Rates: The employer must provide evidence that the terms and conditions of employment are at least equivalent to those provided to Australian citizens or permanent residents in a similar role.

For the Visa Holder:

  • Work Experience: The applicant must have worked for their nominating occupations for at least 2 years on a subclass 482 Visa in the nominated occupation.
  • English Language Proficiency: The applicant must demonstrate competent English language proficiency, typically achieved through approved English language tests.
  • Health and Character Requirements: The applicant must meet the health and character requirements specified by the Australian government.

    Employer Nomination

Employers play a crucial role in the Employer Nomination Scheme Temporary Residence Transition 186 Visa process. Employers need to understand their responsibilities and the requirements they need to fulfil:

    Nomination Process

Employers must lodge a nomination application with the Department of Home Affairs (DOHA). This includes providing detailed information about their business, the nominated position, and the terms and conditions of employment. The nomination must be lodged before the visa applicant can apply for the ENS 186 visa under the TRT stream.

    Visa Application

As a Subclass 482 visa holder aspiring to transition to permanent residency, it is important to be well-prepared and informed about the application process:

    Gathering Documentation

Visa applicants should gather and prepare all necessary documentation, including proof of work experience, qualifications, English language proficiency, and any other supporting evidence required for the application.

    Application Submission

Once the employer’s nomination is approved, the visa holder can submit their application for the ENS 186 visa under the TRT stream. This involves completing the necessary forms and paying the applicable fees. It is advisable to submit a complete and accurate application to avoid processing delays.

Next Steps  after applying for the 186 TRT Visa

After applying, there are several important steps to follow:

    Monitoring Application Status

Applicants should regularly monitor the status of their application through the Department of Home Affairs (DOHA) online portal. This allows them to stay informed about any updates or additional information requests.

    Responding to Requests

If the Department of Home Affairs (DOHA) requires further information or documentation, it is crucial to respond promptly and accurately. Timely responses can help expedite the processing of the application.

Transitioning from a Temporary Skill Shortage Visa to permanent residency via the Employer Nomination Scheme – Temporary Residence Transition stream under the ENS 186 Visa is a structured process that requires careful planning and adherence to the specified requirements. By understanding the roles and responsibilities of both the employer and the visa applicant and by following the outlined steps, the 482 Visa holders can successfully achieve their goal of becoming permanent residents in Australia.

We engaged with Questra through my classmate. After initially consultation with lawyer- Bill, we decided to see how it goes. Basically, you would be assisted by Questra team with your application. Lots of people might think you engage with law firm and paid them nothing is needed to be worried. I have to slightly correct those idea from people who wish engaging with Questra. First of all, it’s your responsibility to provide legitimate information to them. The team of Questra is playing a role like a coach to assist with your application to become more smoothly and persuasively way but remain all legitimate information for your application. Hence, you have to write all information that you wish to include into your application by yourself first. During our preparation phase before offical lodgement of our application, we have been assisted by all Questra team and ensured all supportive information have been provided and if we missed anything, the team will let us know ASAP. We got our 820 very soon after lodging our application within 6 months during Covid, which we were very grateful for the result and after two years of waiting, we continued with Questra to lodge our 801 as they have all information of ours. We received our 801 within 11 months of waiting time. However, this timeframe is just for your reference as each case have different requirements and conditions that might be required more time to process. In the conclusion, we are very grateful to engage with Questra, they made the whole process was so smooth and less hassle for us. We highly recommended to engage with them if your need some assistance with your visa application.

Understanding the new Skills in Demand (SID) Visa Subclass 482

Welcome to the first blog in our three-part series on the new Skills in Demand Visa Subclass 482. The article below covers an overview of the visa, the eligibility criteria and steps in applying for the visa. Stay tuned for the 2 upcoming articles

                1. The complete guide for current and prospective Subclass 482 Visa holders

                2. Transitioning from the 482 Visa to Permanent Residency 186 TRT Visa

The latest Skills in Demand (SID) Visa Subclass 482 is a temporary visa that allows Australian employers to sponsor skilled workers from overseas to fill positions they cannot find suitable Australian workers for. This visa, which replaced the Temporary Skill Shortage (TSS) visa on December 7, 2024, aims to address labour shortages and attract global talent to Australia.

The introduction of this visa is aligned with insights from the Jobs and Skills Australia (JSA), regional demands and input from key industry stakeholders across the country. The SID Visa is a powerful step in responding to the changing economic, social and labour market needs of Australia.

                General overview:

                • Allows the applicant to stay in Australia for up to 4 years
                • Hong Kong passport holders may stay for up to 5 years
                • Costs start from AUD $3,115
                • If eligible, applicant can apply for Permanent Residency

                Eligibility criteria

                1. Eligible occupations

To qualify for the Skills in Demand Visa, your occupation must be listed on the Core Skills Occupation List (CSOL) or meet the income threshold for the Specialist Skills stream. The CSOL covers 456 occupations across critical sectors, with a reduction of 125 occupations from the previous TSS occupation list.

                2. Required skills

Applicants must have the necessary skills and qualifications for the nominated position. This may involve completing a skills assessment to demonstrate your capabilities.

                3. Experience requirement

                • The work requirement has been reduced from 2 years to 1 year of relevant experience. This experience must have been undertaken in the past 5 years and can be in the nominated occupation or a related field.
                • The 1 year of relevant experience is now a Time of Application requirement; meaning you must have the relevant 1 year of experience at the time of your visa lodgment.
                • Applicants can no longer accumulate experience towards the work experience requirement whilst their visa application is processing.

A Pathway to Permanent Residency for Aged Care Workers

A Pathway to Permanent Residency for Aged Care Workers

A Pathway to Permanent Residency for Aged Care Workers

Australia’s aging population poses significant challenges to the healthcare sector, particularly in the aged care industry. To bolster the supply of skilled care workers, the government has introduced an ‘Aged Care Labour Agreement’ that extends visa concessions to nurse support workers, personal care assistants, and aged and disability carers.

This groundbreaking agreement not only streamlines the recruitment of qualified direct care workers from overseas but also offers eligible applicants a pathway to permanent residency. In this blog post, we will explore the agreement’s key provisions, its implications for the aged care sector, and the potential opportunities it presents for aspiring aged care workers.

Aged Care Labour Agreement: Unlocking Opportunities:

The ‘Aged Care Labour Agreement’ is a significant step forward in addressing the ongoing shortage of aged and disability care workers in Australia. The agreement removes the conditions of higher English proficiency and post-qualification work experience to encourage skilled care workers from overseas and also international students in Australia. This opens doors for talented individuals from around the world to contribute their expertise in the Australian aged care sector.

                Key Provisions of the Agreement:

                Visa Concessions for Skilled Occupations:

The agreement extends visa concessions to skilled occupations, including:

                  • nurse support workers,
                  • personal care assistants,
                  • aged and disability care staff.

This initiative aims to attract skilled professionals who can positively impact the aging population’s lives.

                Pathway to Permanent Residency:

One of the most enticing features of the agreement is the two-year pathway to permanent residency. Eligible care workers can apply for permanent residency within two years of working in Australia for their sponsor on a TSS visa, providing stability and security for their future.

                English Language Concessions:

There are English language concessions for workers with relevant community language skills, recognizing the value of diverse linguistic abilities in the care industry.

                Skills and qualifications:

To meet occupation requirements for a TSS visa (subclass 482), you must have at least a relevant Australian Qualifications Framework (AQF) Certificate III or equivalent, or higher qualification, or have 12 months of relevant full time work experience, or equivalent part time experience.

                Work experience:

There are no minimum levels of post qualification work experience that needs to be met to satisfy visa criteria for a Temporary Skill Shortage visa (subclass 482).

                Salary Requirements:

To be eligible for the agreement, care workers must earn a minimum annual salary of at least $51,222 or the Australian Market Salary Rate, whichever is higher.

                Age:

There is no age limit for the Temporary Skill Shortage visa (subclass 482). The age limit for an Employer Nomination Scheme visa (subclass 186) is 45 years of age

                Labour market testing:

The establishment, and maintenance, of an MoU with the relevant industry union(s) will satisfy the labour market testing requirements

                Streamlined Visa Processing:

The agreement offers simplified visa nomination and priority visa application processing, reducing the obstacles for aspiring aged care workers.

Benefits for Aged Care Providers and the Workforce:

The ‘Aged Care Labour Agreement’ presents numerous benefits for aged care providers and the workforce. The agreement addresses the industry’s workforce shortages by restructuring overseas workers’ employment and visa processes and ensuring that aged care facilities can maintain high-quality care standards.

Exploring Skilled Migration in Australia: Discover Exciting Opportunities

Did you know that moving to Australia can open up new possibilities for you and your family?

Many people choose to move there because of the great opportunities it offers. One popular option is skilled migration.

In this article, we’ll explore what skilled migration means and how it can lead to a brighter future. So, whether you dream of being a professional or want the best for your family, let’s learn together!

                Understanding Skilled Migration:

Skilled migration is a way for talented and skilled people to move to Australia. It’s like going on an exciting adventure to find a better life. Let’s find out more about it!

                Who Can Apply:

To be eligible for skilled migration, you need to meet certain requirements. These include things like your age, how well you speak English, your education, work experience, and the job you want to do.

For example, people often search for things like “age limit for skilled migration to Australia” or “what English skills do I need for skilled migration?”

                Earning Points:

Getting points is an important part of skilled migration.

Points are like rewards that show how well you meet the requirements. You can earn points for things like your age, language skills, education, and work experience.

People might look for “points calculator for skilled migration to Australia” or “how do I get points for skilled migration?” to see how many points they might earn.

We also have a free tool to calculate your points here: Australia Immigration Point Test Calculator.

                Different Visas

When you want to move to Australia, you’ll need a special visa. There are different types of visas for skilled migration, like the Skilled Independent Visa or the Skilled Nominated Visa. Each visa has its own requirements and rules.

                Popular Jobs

In Australia, some jobs are in high demand. The government keeps a list of these jobs, called the Skilled Occupation List. It shows which jobs are needed the most.

                Conclusion:

Skilled migration in Australia is an exciting opportunity for people who want to make a better life. By understanding the requirements, earning points, and knowing about the different visas and popular jobs, you can plan for a brighter future.

Remember to check official government websites for the latest information. Whether you dream of being a professional or want to give your family the best, skilled migration can lead you to amazing possibilities in Australia.

Everyone at Questra have been absolutely amazing and delightful to work with. They have assisted me for some years, first with my Chef career pursuing my permanent residency and then with my partner visa. They are extremely competent and have given me all the support needed in these years. All the visas that I applied with their guidance was quickly approved. They do know what they are doing, and I wouldn’t trust anyone else.
